Terms of use, booking, and publication of experiences on NatSnap

1. Ownership and contact

These Terms of Service govern access to and use of NatSnap, a platform owned by NatSnap S.L., with CIF B22614713, registered office at Calle Hirigoien 16, 3 derecha, Lazkao 20210, Gipuzkoa, Spain, and registration details: Commercial Registry of Gipuzkoa, Sheet SS-48402, Electronic volume, Electronic folio, Entry 1, registration date 17/07/2025, EUID ES20014.000254041.

2. What NatSnap is

NatSnap is a digital platform that helps nature and wildlife lovers discover and book experiences offered by independent professionals, such as nature trips, photography hides, wildlife watching experiences, birdwatching, and photography trips.

NatSnap facilitates search, presentation, booking request, initial communication, payment management, and operational coordination of bookings, but professionals are responsible for organizing, providing, and carrying out the experiences they publish.

3. Definitions

For the purposes of these Terms:

  • Client: a person over 18 years old who creates an account, searches for experiences, or requests a booking.
  • Professional: a natural or legal person who publishes, organizes, or provides experiences through NatSnap.
  • Experience: activity, trip, hide, outing, workshop, route, observation service, or any other service published by a professional on NatSnap.
  • Trip: an experience lasting one or more days that may include, as defined by the professional, guiding, activities, accommodation, transport, meals, hides, photography workshops, or other services.
  • Hide: an experience based on the use of a hide or observation point, which may be offered for a full day, morning, afternoon, night, or other available time slots.
  • Booking: a request made by a client and accepted by the professional in accordance with the NatSnap process.

4. Acceptance of the Terms

By creating an account, using NatSnap, publishing experiences, or requesting a booking, the user accepts these Terms of Service and confirms that they have read the Privacy Policy and the Cookies Policy.

NatSnap may display acceptance texts next to account creation, Google or Facebook registration, publication, or booking buttons. The action of continuing, creating an account, publishing, or booking will constitute valid acceptance of the Terms when the legal text is visible and accessible.

5. User and professional accounts

To create a standard user account, NatSnap may request name and surname, email, and password. It may also allow registration or login with Google or Facebook.

To create and operate a professional account, NatSnap may request additional data needed to identify the professional, validate their activity, publish experiences, manage bookings, comply with legal obligations, and make payments.

The user must provide truthful, up-to-date, and complete information. NatSnap may suspend or cancel accounts where there is false data, signs of fraud, legal breaches, abusive use of the platform, or risk to users, professionals, wildlife, the natural environment, or third parties.

6. Minimum age

Account creation and bookings on NatSnap are reserved for persons over 18 years of age.

Minors may participate in an experience only when accompanied by a responsible adult and provided that the specific experience allows it under the conditions established by the professional.

7. NatSnap's role and professional responsibility

NatSnap acts as a technology platform for search, intermediation, and operational management. Professionals are independent and are responsible for their experiences, including description, availability, price, conditions, permits, licenses, insurance, safety, tax compliance, tourism compliance, consumer regulations, environmental regulations, and any other applicable obligation.

The professional declares that they have the capacity, authorizations, knowledge, insurance, and means necessary to offer the experiences they publish. If an experience includes accommodation, transport, meals, guiding, activities, a hide, photography workshop, or other combined services, the professional will be responsible for complying with applicable regulations, including, where applicable, regulations on package travel or linked travel arrangements.

NatSnap does not guarantee the sighting of a specific species. Nature experiences depend on external factors such as weather, season, wildlife behavior, terrain conditions, safety, permits, closures of natural areas, or other circumstances beyond NatSnap's control.

8. Requirements for professionals

Before publishing experiences or receiving bookings, NatSnap may require the professional to provide the following information:

  • Tax name or company name.
  • NIF/CIF.
  • Tax address.
  • Billing email.
  • Contact telephone.
  • Bank account or payout account.
  • Applicable licenses, authorizations, or registrations, where relevant.
  • Civil liability insurance or other applicable insurance, where relevant.
  • Declaration of compliance with tourism, tax, environmental, consumer, safety, and any other applicable regulations.

NatSnap may review, request additional documentation, reject, pause, or remove experiences if it considers that they do not meet platform requirements, there are reasonable doubts about the professional's identity or legality, or risks to users, wildlife, the natural environment, or third parties are detected.

9. Publication of experiences

The professional is responsible for ensuring that the published information is clear, complete, truthful, and up to date, including price, dates, availability, approximate location or meeting point, included services, excluded services, physical requirements, participation conditions, minors policy, necessary equipment, risks, rules of conduct, and any other information relevant to the client.

Published prices must include NatSnap's commission. For now, NatSnap will not apply a visible service fee or management fee to the client, unless expressly indicated during the booking process.

10. Booking process and professional acceptance

All bookings made on NatSnap are booking requests until the professional accepts them. The booking is not considered automatically confirmed merely because the client completes the request process or enters a payment method.

The professional will have a maximum period of 7 calendar days to accept or reject the request, provided that the experience start date allows it. If the professional does not respond within the applicable period, the request may be automatically cancelled.

If a request is rejected, expires, or is cancelled before professional acceptance, the client will bear no cost. If any charge has already been made, NatSnap will manage a full refund.

Once the professional accepts the request, NatSnap will send the client a confirmation by email or through the platform. From that moment, the booking will be subject to the applicable booking, payment, and cancellation policy.

11. Payments and saved payment method

NatSnap uses Stripe as its payment provider. In this initial phase, NatSnap will receive booking payments through Stripe in its own collection account.

Where a booking does not require immediate payment, NatSnap may ask the client to enter a valid payment method to secure the booking and allow future charges provided for in these Terms. In these cases, NatSnap will not make the initial charge unless expressly indicated during the contracting process.

The client authorizes NatSnap to securely save, through Stripe, the payment method entered and to make the applicable charges when the relevant deadlines are reached under the booking and cancellation policy. NatSnap does not store the full card number or security code.

If a charge cannot be completed successfully, NatSnap may contact the client to update their payment method. If payment is not completed within the indicated period, NatSnap may cancel the booking, without prejudice to any amounts that may be due under the applicable cancellation policy.

12. NatSnap commission and settlement to professionals

NatSnap will apply a 15% commission to the professional on the price of the experience, unless otherwise agreed in writing. This commission will be included in the price shown to the client.

Where a booking generates an amount retained due to cancellation or no-show, that amount will be split proportionally: 15% to NatSnap and 85% to the professional, unless another applicable distribution is indicated.

In this initial phase, NatSnap will charge the client through Stripe and manually manage settlement to the professional by bank transfer. To receive payment, the professional must have correctly provided their tax and bank details and issue NatSnap the corresponding invoice for the amounts to be settled.

Except in the case of incidents, cancellations, disputes, security reviews, payout data errors, missing documentation, or missing required invoice, NatSnap will make the bank transfer to the professional between 5 and 10 days before the experience start date. Actual receipt of funds will depend on the operational timelines of the relevant banks.

13. Trip booking, payment, and cancellation policy

Deadlines are calculated in calendar days with reference to the trip start date.

During the last 15 days before the trip starts, the booking is not cancellable with a right to refund, except for cancellation attributable to the professional, a mandatory legal reason, or an express NatSnap decision in exceptional circumstances.

14. Hide booking, payment, and cancellation policy

15. Cancellation by the professional

If the professional cancels a confirmed experience, the client will be entitled to a full refund of the amounts paid or, if they expressly accept it, to an alternative proposed by the professional or by NatSnap.

NatSnap may assess the circumstances of the cancellation, including force majeure, weather, safety, illness, closure of natural areas, administrative restrictions, or other justified causes. If the professional cancels without justified cause, cancels repeatedly, or causes harm to clients or NatSnap, NatSnap may apply measures such as warnings, penalties, temporary suspension, removal of experiences, or closure of the professional account.

16. Date changes and modifications

Date changes, number of places, conditions, included services, meeting point, or other modifications must be managed between the professional and the client once they are in contact.

NatSnap does not guarantee or assume management of changes agreed outside the normal booking flow. Any change affecting price, charges, refunds, availability, or booking status must be communicated to NatSnap or reflected in the platform so that it can be managed correctly.

17. Right of withdrawal

The client acknowledges that the experiences offered on NatSnap are usually linked to a specific execution date or period. In these cases, the right of withdrawal may not apply under consumer regulations for certain accommodation, transport, meals, leisure, or activity services with a specific date or period.

Cancellations will be governed by the booking and cancellation policy indicated in these Terms and in the contracting process, without prejudice to any non-waivable rights the consumer may have under applicable law.

18. Invoicing

In this initial phase, NatSnap will charge clients for booking amounts through Stripe and settle the corresponding amounts to professionals under these Terms.

The professional must issue NatSnap the corresponding invoice for the amounts NatSnap must pay to them. NatSnap will issue, where applicable, the tax documentation relating to its commission or own income according to the applicable operational and tax model.

The professional is responsible for complying with their tax, accounting, labor, administrative, and invoicing obligations arising from the experiences they offer.

19. Responsible conduct and protection of nature

NatSnap promotes responsible, respectful, and conscious nature tourism. Users and professionals must respect wildlife, habitats, the rules of natural spaces, safety instructions, and the instructions of the professionals responsible for each experience.

Any conduct that may harm, harass, feed, chase, disturb, or endanger wildlife, the natural environment, other participants, or third parties is prohibited.

20. Reviews and published content

Clients may publish reviews about completed experiences. Reviews must be truthful, respectful, and based on real experiences. NatSnap may moderate, hide, or delete reviews that are false, offensive, unlawful, irrelevant, promotional, abusive, or contrary to these Terms.

Professionals may upload their own photographs, texts, and materials to describe their experiences. The professional guarantees that they have sufficient rights over such content and that its publication does not infringe third-party rights.

Rights over professionals' photographs and content will remain with their respective owners. NatSnap may use them within the platform to display, manage, and market the published experience. NatSnap will not use professionals' photographs on social media, newsletters, advertisements, or other external channels without authorization where such authorization is necessary.

21. Suspension or cancellation of accounts

NatSnap may suspend, limit, or cancel user or professional accounts where there is a breach of these Terms, false data, fraud, non-payment, serious disputes, abusive use of the platform, security risks, conduct contrary to the protection of nature, or breach of applicable regulations.

22. Data protection and cookies

The processing of personal data is governed by the Privacy Policy. The use of cookies and similar technologies is governed by the Cookies Policy.

23. Modification of the Terms

NatSnap may update these Terms to adapt them to legal, technical, operational, commercial, or platform-functioning changes. Where changes are relevant, NatSnap will seek to inform users through reasonable means.

The version applicable to a booking will generally be the one in force at the time of making the booking request, unless the law requires otherwise or the parties expressly agree to a modification.

25. Applicable law and jurisdiction

These Terms are governed by Spanish law.

Where the client is a consumer, the courts and tribunals that correspond under applicable regulations will have jurisdiction. In relationships between NatSnap and professionals, companies, or users acting for professional purposes, the parties submit, to the extent legally permitted, to the courts and tribunals of Donostia-San Sebastián.

26. Language

These Terms may be available in Spanish and English. In the event of any discrepancy between versions, the Spanish version will prevail, unless applicable regulations provide otherwise.
